On October 30, 2014, the Indiana Supreme Court issued an order amending Indiana Criminal Rule 25, which will go into effect on January 1, 2015. The original version of the rule was issued on December 18, 2013.
One amendment is to Ind. C.R. 25(B)(4) that removes a reference to a nonexistent statute — I.C. 31-37-4-5. The second amendment is to Ind. C.R. 25(B)(3), which changes the wording concerning when counsel must be appointed prior to the child being removed from his or her home.
Advocates for the early appointment of counsel are grateful that the Indiana Supreme Court continues to work on this important issue.
